Escrow Options Group, Inc. (“We”, “Us”, “Our”) is fully committed to the protection and security of the information provided to us by you, our clients, and others who use www.escrowoptions.com. We want you to be comfortable and confident about your privacy, so you can enjoy participating in our online offerings and so that we can better serve your needs.

Our Privacy Statement discloses what you will want to know about Our approach to privacy and how your personal information is collected and used.

Pursuant to the California Consumer Privacy Act of 2018 (“CCPA”), codified by California Civil Code §§1798.100 et seq. and which went into effect on January 1, 2020, California consumers are entitled to obtain more information and control over how their Non-public Personal Information (“NPI”) is being used and requires businesses to be more transparent in their handling of NPI. Although We are not a business that is required to comply with the CCPA, We have implemented a privacy compliance program and procedures to safeguard the NPI of its clients.

Our clients should feel confident that We will preserve clients’ privacy. We have strict guidelines as to how its clients’ NPI is collected and disclosed during an escrow transaction such that the NPI collected from businesses that are required to be CCPA compliant is protected by Our procedures. We are committed to protecting client NPI and will never sell or disclose this information to anyone, except as permitted by law.

Consumers can request a copy of the escrow file if they want to know what NPI is in Our possession.

As part of the CCPA, consumers are entitled to ask businesses to delete their information from their records. However, there is an exemption to this deletion requirement for companies who are mandated to retain records pursuant to the laws of the State of California or the Federal Government. See Civil Code §1798.105(d)(8). We are required to retain records for at least five (5) years pursuant to 10 CFR §1737.3(a). We therefore can only comply with deletion requests if the records are more than five (5) years old.

The following policies also comply with Federal Privacy laws under the Gramm-Leach-Bliley Act, Public Law 106-102 generally requiring the preservation and non-disclosure of non-public personal information.

Requests to Open an Escrow or Find an Escrow Officer

If you submit a request through this site to open an escrow or find an escrow officer, you will be asked to provide Personal Information and we refer this information to sales associates to respond to your request. For example, if you ask to open an escrow in your particular area, you will be directed to an escrow officer in that area.

Location of Servers and Transfer of Information to the United States

The Site is hosted by servers in the United States. If you are located outside of the United States, your Personal Information will be transferred to the United States. By submitting your Personal Information, you consent to its transfer to the United States and to its storage, processing, and use there in accordance with this Privacy Statement.

Scope of this Privacy Statement

This Privacy Statement applies to your use of this Site only. We do not own, operate or control the web sites of our sales associates. Accordingly, this Statement does not apply to a sales associate’s web site or to a sales associate’s collection, use, storage and disclosure of your Personal Information.

3. How We Use Information

We collect information for opening orders, providing services, and/or improving products and services. We may use or disclose the personal information we collect for one or more of the following business purposes:

For example, if you share your name and contact information to request a price quote or ask a question about our products or services, we will use that personal information to respond to your inquiry. If you provide your personal information to purchase a product or service, we will use that information to process your payment and facilitate delivery. We may also save your information to facilitate new orders.

o To provide you with support and to respond to your inquiries.

o To create, maintain, customize, and secure your account with Us.

o To process your requests, transactions, and payments and prevent transactional fraud.

4. Information Sharing

We engage certain trusted third parties to perform business functions and provide services to Us, including hosting and maintenance, error monitoring, debugging, performance monitoring, billing, customer relationship, database storage and management, and direct marketing campaigns. We may share your personal information with these third parties, including service providers and subsidiaries, but only to the extent necessary to perform these functions and provide such services. These third parties are prohibited from using information obtained in this manner for any purpose(s) other than to provide the services We have engaged them to perform. The CCPA prohibits third parties who purchase the personal information

we hold from reselling it unless you have received explicit notice and an opportunity to opt-out of further sales.

Examples of whom We may share information with include:

o Financial service providers as needed to complete your transaction such as other escrow companies, title insurance and underwritten title companies, mortgage companies and lenders, and insurance agents.

o Nonfinancial companies as needed to complete your transaction such as homeowners’ associations, attorneys, bookkeepers and accountants, federal, state, or local tax or governmental authorities, notaries, and real estate sales agents and brokers.

o Service providers as needed to complete your transaction including contractors, structural pest control operators, and others rendering services to you or the real property or business that is the subject of this transaction.

o Data aggregators.

o Affiliated companies which may include financial service providers, such as title insurers, property and casualty insurers, escrow companies, and trust and investment advisory companies, or companies involved in real estate services, such as real estate brokers and agents, appraisal companies and home warranty companies.

o Companies that perform marketing services on our behalf, on behalf of our affiliated companies or to other financial institutions to whom we or our affiliated companies have joint marketing agreements.

o Phone numbers and SMS consent will never be shared with third parties or affiliates under any circumstances

Otherwise, We do not disclose NPI to anyone outside the escrow company without the client’s consent. We restricts access to information contained in escrow files to those employees who need to know that information as is necessary to provide products or services to the client. We maintain physical, electronic and procedural safeguards that comply with state and federal regulations to guard clients’ NPI. Client information is stored in a secure place on a secure computer and in physical files. After five (5) years, when We dispose of old physical paper files, these records are shredded and/or recycled by a bonded security company. When We replace computers, old disks are erased or reformatted before disposal.

We are escrow committed to protecting client NPI and will never sell or disclose this information to anyone, except as permitted by law.
